Conditions of Service

 

  1. No Illegal or Fraudulent Use. The Service may be used only for lawful purposes. Subscriber will not use or allow others to use the service in any manner that is in violation of any applicable federal, state, local or international laws or regulations or to promote, engage in, or enable illegal activity or conduct that violates or infringes upon the rights of any person. Transmission or distribution of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization, and material that is obscene, illegal, defamatory, constitutes an illegal threat, or violates export control laws. In short, streaming or downloading copyrighted material is strictly prohibited and may result in cancellation of service and legal action by 3rd parties. Furthermore, use of the Service to impersonate a person or entity is not permitted. When violations are detected you may receive notices of the fact.
  2. CompuFort reserves the right to disconnect any subscriber for violating any of our policies.  We also reserve the right to make changes and additions to the aforementioned policies and Internet rates. Becoming our Internet Access customer implies that you agree to all terms and conditions as posted on our web site and this agreement. Orders placed by phone will have a copy of this agreement mailed to them.
  3. CompuFort no longer offers Email services for new wireless accounts. For those customers that still have a CompuFort Email address, CompuFort has implemented Spam identification on its Email Servers. All Email arriving at CompuFort’s servers will be checked for Spam characteristics using a combination of filtering techniques including but not limited to: blacklist, phrase identification, statistical and human analysis. Email determined to be Spam may have a unique phrase or phrases entered into the address header and or subject line. The user has the option of using this unique phrase to do his own spam filtering on his or her local computer as the Email is downloaded or when requested this feature will be activated on our server at no charge on a per account holder (user) basis. Email identified as Spam will be moved to a Spam folder on the users mailbox located on our Servers.  Spam emails stored on the server based Spam folder count towards total mail storage. This Spam filtering is not 100% accurate and CompuFort will not be held responsible for false positives or false negatives.  CompuFort will make available for 5 days those messages Spam Filtering has moved to a users Spam folder. These messages will be located in a Spam folder in each activated users Mailbox. This folder can be accessed either by logging into the user account through CompuFort WebMail or configuring a local Email client IMAP account. CompuFort Support will provide assistance at no charge to users needing help accessing their Spam folder but Support will not review, delete or move messages. It is up to the user to review their Spam folder and move any messages they want saved prior to 5 days.  CompuFort will from time to time update or make changes to its Spam Filtering software or procedures as it sees fit and in the best interest of CompuFort and its customers. CompuFort will enable/disable Spam filtering on the user’s account within 12 hours of receiving authorized verbal, written or emailed notice during a normal workday.  On weekends and holidays the required Spam action will be taken during the next scheduled business work day. CompuFort may at its discretion block or delete certain Emails detected as coming from known Spammers. These emails will not be available for retrieval.
  4. Service Commitment:  Before or at the time of installation it was determined that your location would support CompuFort Wireless service at the above listed speed at the radio/antenna location and height. This determination takes into account a degree of variability in the factors listed  below that can cause a reduction in speed or temporary loss of service:
  1. This is a unlicensed band subject to use by other equipment and people. Examples of this are baby monitors, wireless home phones, Utility Companies, municipalities and other WISPS (Wireless Internet Service Providers).
  2. Environmental and geographical conditions change: Examples of this are leaves on trees, height of trees and to a lesser degree extreme humidity from extended rainfall.
  3. Location and use of other electronic equipment near the wireless equipment.

Remedies: If the Compufort Wireless service speed becomes consistently below par, that is below the minimum speed and/or periodically  on a daily basis drops service for more than 120 seconds in duration, and it’s determined not to be the fault of the radio and can not be remedied by reasonable relocation of the receiving equipment or other interfering equipment or replacement of the equipment itself, Compufort for the first 6 months will refund the full invoice price of the Wireless Indoor radio/antenna unit or Wireless Outdoor Radio, whichever is applicable. Labor, outdoor tripods, masts, cables and other routers or equipment purchased with the system are not refundable.  For the remainder of the first year, Compufort will refund 50% of the invoice price of the Wireless Indoor radio/antenna unit or Wireless Outdoor Radio, whichever is applicable. Labor, outdoor tripods, masts, cables and other routers or equipment purchased with the system are not refundable. If during the first year it’s determined that the Wireless Radio is the problem it will be replaced with a different unit of the same or functionally same model. If during this year it’s determined that reasonable relocation of the receiving equipment will resolve the issue Compufort will assist in the relocation of the equipment at no charge. Reasonable relocation means moving the radio on the same roof or adjacent roof or pole, raising the height of the radio by using a taller tripod and or mast (this does not cover erecting a new or different tower beyond 10’). Compufort will at the customer’s request and expense assist in installing a new tower of adequate height or adding sections to an existing tower if that’s deemed feasible.

  1. SERVICE CANCELLATION:  If you decide to cancel your internet service before 3 months has passed, the cost of the service for the 1st paid period will not be refunded. Certain conditions may apply

 Limitation of Liability. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL COMPUFORT OR ITS SUPPLIERS OR EMPLOYEES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF COMPUFORT SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

 

 

Billing starts upon activation of the account and is payable by the first of the month.  Customers will be notified by a Postal letter approximately 15 days before the end of the term. Non-payment of your account by the end of the grace period will result in deactivation of the account and may result in late fees.   Grace period is thru the 15th of the next month following expiration.  We reserve the right to change any policies and rates.  See Web site posting at Compufort.com for policies.
